On February 8, 2012, the Ottumwa Police Department took into custody twelve-year-old David E. McGee, Jr. after investigating complaints of harassment from at least twenty-one students at Evans Middle School. Iowa law states a person commits harassment when the person, purposefully and without legitimate purpose, has personal contact with another person, with the intent to threaten, intimidate, or alarm that other person. The investigation began after numerous students approached school officials about being harassed by McGee. Harassment is a violation of Chapter 708.7 of the Code of Iowa and is a Simple Misdemeanor. McGee was released to a parent. Chief Jim Clark stated, “The Ottumwa Community School District and the Ottumwa Police Department partner together to provide the safest learning environment possible for students and staff at Evans Middle School. Whenever we receive complaints of a student harassing others, we will investigate and take the appropriate action to ensure each student is free from threats or intimidation.
